General Terms and Conditions
The use of the contents of and the illustration of the www.romantikhotels.com website are governed by the following instructions and rules:
1. Reservation Inquiries and Online Bookings
Reservation inquiries are forwarded by Romantik Hotels & Restaurants GmbH & Co KG (hereinafter referred to as: "Romantik Hotels") as the umbrella organisation of the "Romantik Hotels & Restaurants International" cooperation in its function as a communicating messenger on behalf of the traveller (hereinafter referred to as: the "Romantik Guest") to the respective concretely selected Romantik Hotel for consideration and confirmation. Online bookings are carried out directly "online" using the reservation platform of a strategic Internet partner of "Romantik Hotels". In either case, "Romantik Hotels" assumes neither the function of an agent nor that of a tour operator in relation to the "Romantik Guest".
2. Conclusion of Contracts and Contract Parties
The lodging agreement and contracts regarding other ancillary services (such as theatre tickets etc.) are concluded exclusively between the "Romantik Guest" and the selected Romantik Hotel or the respective third-party provider for the ancillary services.
The "Romantik Guest" is responsible for payment of the costs associated with lodging and possible ancillary services reflected within the framework of the booking directly to the hotel or the third-party provider of the ancillary services, unless agreed otherwise between the Romantik Hotel and the "Romantik Guest".
All claims and obligations resulting from the lodging agreement or other contracts exist directly and exclusively between the "Romantik Guest" and the Romantik Hotel or third-party provider of potential ancillary services selected by such guest. The respective effectively included terms and conditions of the individual Romantik Hotels and potential third-party providers apply accordingly.
3. Copyright and Trademark Right
The website www.romantikhotels.com includes data, information and illustrations, for which the copyright and/or trademark rights are reserved for "Romantik Hotels" or in individual cases also for the benefit of third parties. Any duplication or use of graphics, texts or other contents of this website in other electronic or printed media and publications, particularly copies, reproduction, dissemination, electronic archiving, transfer of data to other data carriers, even if only in excerpts, or the use for purposes other than those intended here, is only permitted upon prior consent by "Romantik Hotels".
Expressly allowed is the technical duplication for the purpose of browsing, insofar as such action does not serve any economic purposes, as well as the permanent duplication for personal use.
4. Liability
The hotel information (images, text, site plans, pricing etc.) provided among other things on the www.romantikhotels.com website have been verified to the best of "Romantik Hotels" knowledge and belief and will be verified also in the future at regular intervals. Ultimately, however, the information are based on the data provided by the individual Romantik Hotels or information submitted or provided to "Romantik Hotels" by trustworthy third parties (such as press agencies). "Romantik Hotels" attempts to assure accuracy in terms of contents, timeliness and completeness of the hotel information as best possible on a regular basis. The accuracy in terms of contents, timeliness and completeness, however, cannot be guaranteed with complete certainty so that the "Romantik Hotels" are not responsible and "Romantik Hotels" cannot be held liable for the inaccuracy or incompleteness of the hotel information.
"Romantik Hotels" also proceeded with utmost care in gathering all other information on the www.romantikhotels.com website. However, no liability can be assumed for potential errors occurring in terms of data collection or data transmission. Therefore "Romantik Hotels" does not warrant the accuracy and timeliness of the contents provided.
References and links to the websites of third parties shall not be interpreted as "Romantik Hotels" embracing the contents associated with the reference or link. The contents do not constitute any responsibility on the part of "Romantik Hotels" for data and information provided there, unless "Romantik Hotels" has been informed of the contents and can be reasonably expected to technically prevent the use of the links should they have unlawful contents.
"Romantik Hotels" does not assume any liability for failure to meet the duty of ordinary care, insofar as no material duties, life, limb or health are affected or claims according to the product liability act are concerned. This applies accordingly for the violation of duties by subcontractors of "Romantik Hotels".
"Romantik Hotels" is only liable for compensatory damages " regardless for what legal reason " in the case of malicious intent and gross negligence. The liability is in principle limited to damages that are reasonably foreseeable at the time of concluding the contract.
5. Data Protection
The data protection guidelines apply in their respectively current version.
6. Applicable Law / Legal Venue
All legal relations between "Romantik Hotels" and the user are governed exclusively by the laws of the Federal Republic of Germany.
Where allowed, Frankfurt am Main is being agreed upon as the exclusive legal venue for all disputes arising from this usage relationship. Otherwise the statutory legal venue applies.
